Difference Between APA and MLA

When conducting research papers, there are two major styles we can choose. The first style is MLA style. MLA style is more commonly used to write papers and cite sources within the liberal arts and humanities category. The second style that we use for research papers is APA style. APA style is commonly used to cite sources within the social sciences category. So far in my writing career I have only experienced writing MLA format. I am excited to conduct my next library research on immigration using the APA style. In this journal entry, I will be exploring some key aspects of using APA style and exploring some major differences between APA and MLA styles.
The general format of the APA format includes: a title page, page numbers and running head, an abstract, headings, visuals, and a list of references. The title page should include a running head for publication purposes, a title, and byline. Going with the title page includes page numbers and a running heading. On the upper right-hand corner of each page, there should include a 1-2 word version of the title. Next follow the title with five spaces and then the page number. The abstract is a 75-100 word overview of the essay and should be on its own separate page after the title page. Visuals such as tables and graphs can be very useful in providing supplements to the research paper. The visual must be as simple as possible clearly labeled. Finally, similar to a works cited page in a MLA style paper, an APA research paper need a list of reference. The list of reference must have a title that is centered from the top of the page and double spaced. The list must be alphabetized by last name of the authors.
MLA papers on the other hand, do not include a separate title page but do contain a works cited page unlike the reference page of APA papers as mentioned. The first page in the upper left-hand corner of an MLA paper should include your name, your instructor's name, the course title, and the date, all double spaced. All pages should be numbered in the upper right-hand corner and the title should be centered. The works cited page should begin on a new page must be numbered and alphabetized by the author's last name first. Obtaining a Default Judgment in California by Declarations

The topic of this article is obtaining a default judgment in California by the use of declarations without having to appear in Court.
Code of Civil Procedure Section 585(d) allows a default judgment to be entered using declarations in lieu of personal testimony. This avoids the time and expense of a Court hearing. In fact in many counties in California this is the preferred method, only in unusual cases will the Court require a "prove-up" hearing. This is particularly true now that the budget crisis in California has resulted in major staffing cutbacks in most Courts.
Note that if punitive damages are requested that some Courts and Judges will require a "prove-up" hearing.
Obviously, a default must be entered against the defendant before a default judgment can be obtained. The default can be requested separately before any default judgment, in some cases this may be helpful as it may take time to obtain the necessary documents and signatures. Judicial Council Form CIV-100 Request for Entry of Default is used to have the default entered, and must also be used to have the default judgment entered as well. The appropriate boxes on the form must be checked, and when a default judgment is requested, the principal amount, the accrued interest, and any court costs and attorney fees must be entered as well.
Next the following documents must also be submitted in support of the request for default judgment.
Judicial Council Form CIV-110 Request for Dismissal to request the dismissal of all fictitiously named or "DOE" defendants. Many Courts will require this before a default judgment will be entered.
Statement of case (also known as summary of case) in support of request for default judgment. This must contain a brief summary of the causes of action against the defendant and the amounts requested for each particular cause of action. This must be prepared on pleading paper.
Declaration regarding calculation of pre-judgment interest. This is required when pre-judgment interest is requested and must detail exactly how the pre-judgment interest has been calculated such as interest rate, yearly interest divided by 365 which equals a daily interest which is then multiplied by the number of days since the breach of contract, or other event. This declaration can also contain the details as to any attorney fees requested that are allowed by contract or statute. If a written contract is involved then Civil Code Section 1717 would apply. In actions based on a book account as defined in Code of Civil Procedure Section 337a entered into on or after January 1, 1987, the statutory attorney fees available under Civil Code Section 1717.5 are available.
Many Courts have a schedule for attorney fees in their local rules such as Los Angeles County Superior Court Local Rule 3.214 which provide the calculation basis for the attorney fees unless the Court orders otherwise. The attorney fees should be calculated by adding the principal amount, the accrued interest, and the Court costs, then using the total figure as a basis for calculating the attorney fees.
Any request for fees in excess of that provided in the local rules would have to be supported by documentation showing the hours spent on the case, and why the excess attorney fees are justified. This declaration must be prepared on pleading paper.
Declaration of plaintiff or cross-complainant in support of request for default judgment. This must contain all the ultimate facts and relevant dates which support the claim or claims against the defendant, and also contain any exhibits in support of the claims. This must also be prepared on pleading paper.
The original of any promissory note or other written obligation to pay money such as a negotiable instrument, if any, upon which the action is brought must be submitted to the Court, either separately or as an exhibit to the declaration. If the original is not available that fact should be noted in the declaration to avoid rejection of the default judgment package.
The court clerk is required to note across the face of the writing, over his official signature, the date and fact that judgment has been rendered on such contract. See California Rule of Court 3.1806.
Proposed default judgment. This must be submitted for signature by the Judge. It should contain all of the relevant amounts such as principal, pre-judgment interest, court costs, any attorney fees that are requested, and also should state the total amount of the judgment. Some Courts may require that a party use the JUD-100 Judicial Council Judgment Form instead of preparing a proposed judgment on pleading paper even though JUD-100 is listed as an optional form.
Plaintiff should make every effort to find out beforehand if any additional forms may be required by local Court rule as some Courts do have specific local forms. A search of the local rules themselves may be of great assistance in that area.

CAUSES OF FALLING STANDARDS

(5) Teachers not being part of the examination bodies. One wonders whether the continuous Assessment submitted by these teachers are used or not.

(2006) observed that only 23% out of the then 400,000 primary schools in Nigeria have grade II even when NCE is now the minimum qualification for teachers at primary and Junior Secondary schools.
(9) Teachers welfare: It is no longer news that
(a) Politicians do not have negotiation council to negotiate their salary increase.
(b) There is no disparity among political office holders from the federal, state and local governments.
(c) Their salaries are increased at astronomical manner.
(d) Their salaries are increased any time without recourse to whether the nation's economy can bear it or not.
(e) But for teachers, they must negotiate the 10 to 20% of an attempt to increase their salary with consideration of the economy of the nation. We have seen the causes of falling standards and from these causes we can deduce that the following are to be blamed:
1. Government suppose to carry the lion share of the blame because all the other variables are dependent variables to it.
2. Teachers also have their shares of the blame with regards to their diligent duties.
3. Parents: feeding has to be provided by parents. This is because parents do not leave schools to operate without interference.

SOLUTION

Performance should be regarded and respected more than just paper qualification. Equally, education should not be politicized for whatever reason.
Policy makers should be mindful of policies that affect education .eg JAMB(UTME) regulation in admissions.
Teachers should be involved in examination activities and examination bodies should always publish examination reports and distribute it to various schools for them to hold school workshop for training of subject teachers on their areas of weaknesses observed in the students' scripts with regards to following the marking scheme.
More schools should be built to increase accessibility by all. Cognitive, affective and psychomotor domain should be used for assessment of students.
Teachers' welfare should be given priority by government to avoid unnecessary strikes in our educational sector while more qualified teachers should be employed to curb the present shortage of teachers in our schools.
Our civilian government should prove to the people that they are better than military government.
Teachers should be trained so that they can meet up with any new challenges Educational facilities should be upgraded to modern standards while teaching facilities should be adequately provided.
Corruption should be eliminated to the barest minimum by all stakeholders while government should increase its budgetary allocations to education to improve the standard of education in Nigeria.
